Discord BOT Terms of Service

These KuronekoServer Discord BOT Terms of Service (the “Terms”) set forth the conditions for using the Discord BOT provided by the KuronekoServer operations team (the “Operations Team”).

Any person who uses the Service (the “User”) must use it in accordance with these Terms.

Article 1 (Applicability)

1. These Terms apply to all relationships between the User and the Operations Team relating to the use of the Service.
2. In addition to these Terms, the Operations Team may establish separate rules, guidelines, or other terms of use (collectively, the “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.
3. If there is any discrepancy between the Individual Provisions and these Terms, the Individual Provisions shall prevail unless otherwise specified.
4. If the terms of the service providers (e.g., Discord) conflict with these Terms, the providers’ terms shall prevail.

Article 2 (Prohibited Conduct)

In using the Service, the User must not engage in any of the following:

1. Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (the “Organization”), or services provided by third parties, via the facilities of the Service.
2. Acts that impose unnecessary load (whether intentional or negligent) on the Organization’s facilities (network/server facilities, etc.), thereby impairing service quality or the ability of upstream providers to provide their services.
3. Acts that intentionally use the Service in a manner intended to satisfy the requirements for disclosure requests under the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Sender Information (the “Provider Liability Limitation Act”), or acts that may lead to such use.
4. Infringing our rights or those of others in a way subject to lawful disclosure of sender information.
5. Acts that tamper with information used in IP network services, or acts that may do so.
6. Unauthorized access to the Service, attempts thereof, or transmitting information that contains harmful computer programs.
7. Violations of laws and regulations in Japan, or acts that encourage illegal conduct.
8. Acts that involve any interaction or involvement with anti-social forces (organized crime groups, members thereof, right-wing groups, anti-social forces, or similar; the same applies hereinafter), including cooperating with or participating in their maintenance, operation, or management.
9. Illegal use or abuse of bugs, defects, vulnerabilities, etc. against the Organization.
10. Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
11. Violations of the terms of service and/or guidelines of the service provider.
12. Impersonating other Users, the Operations Team, or KuronekoServer.
13. Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
14. Commercial use of the Service for business/profit purposes (applies to the VOICEROID read-aloud bot only).
15. Recording or streaming exVOICE audio (applies to bots that provide read-aloud features only).
16. Broadcasting synthesized voices on streaming services (applies to the VOICEROID read-aloud bot only).
17. Failing to include voice credits/attribution in the description/credits of streaming services (applies to VOICEVOX/SHAREVOX/COEIROINK read-aloud bots only; the required form of attribution is defined by each voice synthesis provider’s terms on their official site).

18. Other conduct reasonably considered to impair safe service provision, such as unlawful conduct or serious harm to others.

Article 3 (Restrictions)

We may restrict or suspend use where necessary to protect the Service or users from violations, excessive load or misuse. We normally explain the reason and how to resolve it, but may act without advance notice in emergencies. Users may request an explanation or review at support[at]krnk.org (replace [at] with @). Liability is governed by Article 10.

Article 4 (Suspension of use)

We may suspend use or terminate a contract for reasonable grounds such as serious violations, unlawful conduct or misuse. Where correction is possible, we normally give reasons and a deadline to resolve the issue. Suspension from another service does not automatically suspend this Service; we assess its impact here. Urgent security needs or legal requirements may require immediate action.

Article 5 (Preservation of Communication Logs)

We may preserve necessary communication records under law or a lawful preservation request. Preservation does not remove protection of communication secrecy or other legal safeguards. Disclosure requires a lawful basis and is limited to what is necessary.

Article 6 (Commencement of Use and Usage Restrictions)

Read these Terms and the in-service guidance before using the Service. Minors must obtain guardian consent and complete any other procedures required by law.

Article 7 (Termination or Suspension of the Service)

The Service may be terminated or temporarily suspended for any of the following reasons.

1. When performing maintenance, inspection, or repair of equipment necessary to provide the Service.
2. When performing maintenance work on server equipment.
3. When updating programs.
4. When server equipment or programs stop due to accidents, crashes, etc.
5. When continuation of operation becomes difficult due to unforeseen events such as earthquakes, lightning, or heavy rain.
6. Any other case where the Operations Team determines that it is difficult to continue operating the Service.

Article 8 (Changes to the Service)

Planned changes, suspension or termination will be announced on the official website or through other appropriate means, with reasonable notice reflecting their impact. If an incident or urgent security need prevents advance notice, we will inform users afterwards where possible. Any payment settlement or refund follows contract terms and applicable law.

Article 9 (Reporting Contact)

1. Report unlawful or inappropriate content to abuse@krnk.org, including:

   • Your name and contact email address
   • For copyright complaints, evidence that you are the rights holder or an authorized representative
   • The relevant URL or IP address
   • The reason for your report

2. For vulnerabilities, see the dedicated reporting page.

3. We normally review and respond to reports within 24 hours.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

1. We do not guarantee continuous availability, freedom from errors, suitability for a particular purpose or permanent data storage. Keep your own copies of necessary data.
2. Where we bear legal responsibility, we respond under applicable law. We do not exclude or limit liability for intentional misconduct, gross negligence or any liability that law does not permit us to exclude or limit.
3. Users normally resolve disputes with each other or third parties themselves. This does not exclude any legal responsibility we bear.

Article 11 (Changes to the Terms)

Changes to these Terms follow the Civil Code and other applicable law. We announce the changes and effective date in advance on the official website or by other appropriate means. Where individual consent is legally required, we obtain it separately.

Article 12 (Handling of Data)

The Privacy Policy for this Service explains the information we handle, its purposes, retention, disclosure and requests for access or deletion. Disclosure to public authorities also requires a lawful basis and is limited to what is necessary.

Article 13 (Governing Law and Jurisdiction)

Japanese law governs these Terms. The Saga District Court is the agreed court of first instance for disputes about the Service, without limiting other jurisdiction or consumer rights recognized by law.
